An attentive reader brought this to our attention: after reading an opinion from the Federal Circuit that reads more like an amicus brief for vacating a grant of cert in a significant patent case before the US Supreme Court (which we wrote about here), Mark Lemley, an influential law professor who often writes amicus briefs before the Supreme Court on patent cases, switched sides. Did the Federal Circuit's opinion violate some sort of ethics rule? It certainly had what we thought was its intended effect....
